条款及细则

本条款及细则(以下称“细则”)适用于DFS提供的任何在线服务的使用和注册,此类在线服务可通过以下网址获取:dfs.com(“网站”)。

 

本细则的目的是确定DFS与任何年满18周岁的非商业自然人之间的权利和义务,这些自然人出于满足个人需求而希望使用网站(使用网站者称为“用户”)或在网站上购物(购物者称为“顾客”)。特别是,本细则规定了顾客订购的产品(定义见下文)的订购、付款和退货管理的条件。

 

本细则包括本序言、A部分中的一般条款以及明确指出适用于特定国家/地区的任何后续部分(“国家/地区特定部分”)中的条款。因此,DFS向顾客提供的产品的供应和购买以及服务的提供将受本序言、A部分以及提供这些产品和服务的具体国家/地区适用的国家/地区特定部分的约束。此外,除非另有说明,本细则中提及DFS等同于提及国家/地区特定部分中定义的DFS,提及的网站仅包括提供这些产品和服务的国家/地区适用的网站部分。如果A部分中的任何规定与国家/地区特定部分中的任何规定存在任何冲突,则以后者为准。

 

DFS可能不时更新或修订本细则,此类更新和/或修订将在网站上公布修订版本(“新条款”)后立即生效。

 

通过网站订购任何产品即意味着无条件接受本细则。

 

在与顾客进行任何交易之前,特别是在组织推广活动的情况下,网站上可能列出任何特殊条件,此类特殊条件可以作为本细则的补充。

DFS同意通过网站出售包括家居用品、时装和配饰在内的产品(“产品”),前提是任何此类销售和所有权转移仅在顾客于店内领取产品时发生。

 

网站上展示的产品符合相关司法管辖区适用的现行法律和标准。如果产品因不符合规定而需要从市场撤回,相关产品将尽快从网站下架。正在进行的订单将自动取消,顾客对于涉及此类取消的投诉没有追索权。

 

在通常情况下,顾客在下订单之前可以在网站上看到产品的基本特征。网站展示产品的主要特征,具体包括产品规格、图样以及产品尺寸或容量的说明。

 

网站上展示的照片和图形不具有合同效力,DFS不对这些照片和图形负责。

 

顾客对选择和购买产品承担全部责任。顾客应查阅每件产品的描述,以了解其特性和重要特征。

 

顾客最迟应该在确认订单时,对本细则中规定的合同信息进行确认。

在遵守国家/地区特定部分的任何具体规定的前提下,产品以现行价格供应,并且现行价格是网站上显示的价格。 

 

价格考虑了DFS可能在网站上授予的任何折扣。

 

货币换算器显示的价格仅供参考。

 

这些价格是确定的且不可修改,如订购时网站上所示。但是,DFS有权随时修改价格,此类修改不会影响任何已生效的订单。

 

DFS定期检查以核实收取的价格是否正确。但是,某些价格可能包含错误。如果DFS在订单中发现价格书写错误,会尽快通知顾客。DFS有权取消受价格书写错误影响的产品订单。如果订单已付款,顾客会获得已付金额的退款。 

 

 3.1–下订单

 

顾客可以根据以下步骤自行选择想要在网站上订购的产品:

 

  • 顾客将产品添加到购物袋中;

  • 顾客在检查和修改(如有需要)购物袋的内容后,通过点击“结账”让购物袋生效;

  • 顾客输入自己的个人详细信息; 

  • 顾客选择免税或已完税选项,并在适用时输入其国际航班详情; 

  • 顾客输入店内取货所需的详细联系方式,然后点击“继续”;

  • 如果适用,顾客选择额外优惠(例如样品或礼品),然后点击“继续”; 

  • 顾客同意遵守所有适用的国家/地区特定要求、本细则和DFS隐私政策; 

  • 顾客写明信用卡类型和相应的卡号(或使用DFS接受的其他付款方式);

  • 顾客确认账单地址无误,然后点击“核实订单”;

  • 顾客在订单摘要中检查所有输入的信息,并点击“确认订单”,以确认摘要无误并继续付款;

  • 顾客被重定向到可以完成订单确认的摘要页面。DFS会向顾客发送一封电子邮件,确认收到订单。

 

建议顾客在确认订单之前检查订单的详细信息、总金额并更正任何错误。顾客有责任核实订单和所提供的信息的准确性,并立即向顾客服务部报告或纠正任何错误。

 

DFS无意将网站上的产品出售给专业人士和其他商家,这些产品仅出售给消费者或非专业人士,用于满足他们的个人需求。

 

因此,如果订单中单件产品的数量可能超过顾客个人合理需求,则DFS有权拒绝订单。

 

3.2–订单生效

 

只要产品出现在网站上并且易于从现有库存中提货,产品供应即为有效。顾客应了解,产品供应和某些产品可能仅在某些特定国家/地区适用。

 

DFS会在顾客确认订单后最多1(一)个工作日内向顾客发送电子邮件,以确认订单。根据细则和上述方法在网站上下达的任何订单,在经顾客确认生效并且DFS确认后,即构成顾客与DFS之间的出售协议。

 

在订单下达后,如果由于任何原因造成全部或部分产品无法供应,DFS将尽快通过电子邮件告知顾客产品无法供应,并且告知顾客订单已部分或全部取消。

 

在DFS取消订单的情况下:

  • DFS顾客服务部将通过电子邮件与顾客联系以告知顾客;以及

  • DFS将取消相关产品的订单并退款。

 

3.3–顾客责任 

 

顾客进一步认可并同意,如果顾客不遵守国家/地区特定要求,顾客将负责承担产品的所有适用税费和关税,包括但不限于增值税以及商品及服务税。在此情况下,除显示价格外,还将从顾客的信用卡或通过其他付款方式收取顾客应承担的所有适用税费或关税金额。

 

4.1–可用的付款方式

 

顾客可以使用以下方式支付订单:Visa、万事达卡、微信支付、支付宝和/或不时可用的其他支付方式。

 

在网站上实施的交易已委托给如下安全在线支付平台:

顾客的信用卡数据,包括信用卡号、到期日、信用卡识别码(“CID”)和视觉密码,是由服务提供商使用安全方式传输到银行,此类安全方式确保数据对第三方保密。

 

4.2–支付条款

 

下订单时,顾客通过以下步骤支付订单:

  • 顾客指明支付方式,提供信用卡号、持卡人姓名、到期日、CID和可视密码(如果适用);

  • 顾客输入账单地址;

  • 顾客点击“核实订单”,确认订单的详细信息;

  • 顾客确认订单生效并同意支付价格。在订单生效后将从顾客使用的信用卡扣款。

 

顾客可以使用DFS接受的其他付款方式,在此情况下,上述条款同样适用,并且可进行任何必要的更改或调整。 

 

支付指令无法取消。顾客对订单的付款不可撤销,但不影响顾客在适用的非排他性消费者法律下可能拥有的任何权利。

 

4.3–打击欺诈和消除未偿债务

 

为打击欺诈和消除未偿债务,DFS有权在付款期间要求顾客提供更多信息,或者取消或暂停订单。

 

4.4–电子发票:

 

只要符合发出订单的国家/地区和即将收到或已经收到产品的国家/地区的税收法律,并且顾客在实际领取产品时全额支付了订单款项,则DFS将向顾客开具发票。

  

只有在顾客全额支付产品价格后,产品所有权才转移到顾客。

 

产品相关的损失和损坏风险只有在顾客实际拥有产品时才转移到顾客,而不考虑产品所有权的转移日期。因此,产品运输过程中的的风险由DFS承担,直到顾客实际取得产品。

6.1–条件

 

按照商业惯例,DFS会在购买之日起30(三十)日内退款,退回的任何产品应附带原包装、完好无损、未使用、未洗涤、未损坏、未磨损,如果适用,需附有与订单相关的预付退货标签。

 

退款将按照订购时使用的付款方式处理。

 

6.2–方法

  • 顾客准备外包装并且打包相关产品,确保产品在运输过程中得到充分保护;

  • 顾客联系顾客服务部安排退货的实际细节;

  • DFS将在收到包裹后的2(二)个工作日内检查退回的商品。

 

顾客请知悉,在某些国家/地区,根据国家/地区特定要求,顾客可能需要前往DFS店铺并将产品退回DFS店铺。顾客应联系顾客服务部以了解详情。 

 

6.3–退回产品的核查

 

DFS将对每条退款请求进行合规性检查。

 

检查结束后,如果退货产品符合本细则第6.1条的规定,DFS将按照订购时使用的付款方式处理退款,最长期限为15(十五)个工作日。

 

DFS不接受不符合规定条件的退货产品,此类产品将退还给顾客。

 

如果在订购或领取产品期间出现任何困难,顾客可以通过clientservice@dfs.com或在线聊天功能联系顾客服务部(“顾客服务”)。

 

DFS贵宾会员计划(“DFS旗下T贵宾会”或“计划”)包括四个等级:T贵宾会、翡翠卡、尊誉宝石卡和尊誉钻石卡。会员计划的权益因等级而异,请点击此处了解详情。

 

每个账户只要在24个月的会员周期(“会员周期”)内至少有一次合格购物,且未发生退货、折扣、退款或调整(“合格购物”),即可分配会员等级。

 

DFS旗下T贵宾会的会员卡(“会员卡”)由DFS酌情发放,可以是电子卡或实体卡。DFS旗下T贵宾会的会员(“会员”)有权享受会员计划的权益和奖励,此类权益和奖励由DFS根据本细则不时确定。DFS可以随时更新或修改本细则,恕不另行通知。 

 

8.1–资格

 

会员计划面向年满18岁的顾客,T贵宾会持卡人(“持卡人”)只能将会员卡用于个人和非商业目的。

 

持卡人在任何时候都只能拥有一个活跃账户,DFS有权合并、修改或取消属于同一持卡人的重复账户。

 

在某些司法管辖区,在持卡人仅购买烟草制品或酒精饮料的情况下,不分配会员等级。

 

8.2–注册

 

顾客可以在店铺内由DFS销售人员协助完成注册流程,也可以线上注册(包括使用店内提供的二维码通过微信注册)。

 

通过线上渠道注册会员计划的持卡人将在购物当天赚取T贵宾卡积分(“积分”)。积分将在7(七)个工作日内记入持卡人的账户。

 

8.3–变更会员等级身份和续期

 

根据持卡人在会员周期内的净合格购物金额(即合格购物金额减去税费、折扣、退款、汇率和其他调整),以“等级金额”的形式记录合格购物。每消费1美元或等值金额,持卡人的会员账户将赚取1个等级金额。

 

如果持卡人在会员周期内赚取了足够的等级金额,符合升级到更高等级的资格,则会员等级的变更将在持卡人实施合格购物之后的7天内完成。

 

如果持卡人在会员周期内没有赚取足够保持现有等级的等级金额,则会员等级会降到下一个等级,并且等级金额将清零。

 

等级变更后,持卡人的会员周期将从变更当月起续期24个月。持卡人可以在微信上或者点击此处在dfs.com上查看自己的等级身份和积分余额。

 

8.4–积分的赚取

 

持卡人在参加会员计划的全球DFS店铺和T广场店铺购物时凭会员卡可赚取积分奖励。店内销售人员可能会要求持卡人出示附照片的有效身份证件以核实身份。点击此处查看参与计划的品牌及店铺列表。

 

如果持卡人在购物时未出示会员卡,可以在购物之后的6个月内,凭会员卡、销售收据和付款证明请求补记积分,DFS将在收到请求后的6周内将遗漏的积分记入持卡人账户。日期久于持卡人注册加入会员计划之前1个月的购物不能赚取积分。

 

赚取的积分是基于扣除税费、折扣、任何积分或礼品券/优惠券或者交易中使用的任何等效支付形式的价值后,以美元计算的支出金额。在美国境外的DFS和T广场店铺购物所赚取的积分,是基于当地货币转换为美元的金额,转换时使用DFS当地汇率合作伙伴的每日或每月汇率。针对法国,欧元兑换成美元是基于LCL的汇率加上加价。针对意大利,欧元兑换成美元是基于意大利银行的汇率加上加价。

 

针对服务类(例如餐厅、沙龙服务等)、选定品牌/精品店商品、烟草和酒类等不符合条件的品类的购买,以及购物中的任何费用或税费或者使用积分或礼品卡/券支付的部分,持卡人不能赚取积分。 

 

积分将在合格购物之后的7个工作日内记入持卡人的账户。持卡人每产生1美元的合格购物皆可赚取积分。所获得的积分数量取决于会员等级:

在计算记入持卡人账户的积分数量时,将合格购物的美元金额乘以持卡人会员等级相对应的积分乘数,对于美国境外DFS店铺和T广场店铺的合格购物,将当地货币金额按照上述汇率转换为美元金额后再乘以积分乘数。如果持卡人退回购买的商品,将使用相同的计算方法来确定应从其未结积分余额中扣除的积分数量。

 

对于在dfs.com或微信上购物所赚取的积分,将在持卡人前往参加会员计划的店铺内凭会员卡完成订单并领取商品后24小时内发放。

 

8.5–积分兑换

 

500 T贵宾卡积分 = 5美元的净合格购物金额*

(*即,合格购物金额减去税费、折扣、退款和其他调整)。

 

持卡人可以在交易中直接兑换积分,最少需要500积分,但优惠券除外,需要至少1000积分才能兑换。兑换时只能按100积分的倍数进行计算。

 

积分可用于在全球参与计划的T广场和DFS店铺购买商品。点击此处查看参与计划的店铺及品牌列表。

 

积分不可兑换DFS线上平台或微信小程序上的任何预订(DFS中国香港和中国澳门微信小程序除外)。

 

持卡人在参与计划的任何店铺使用积分购买商品时,或在所选的参与计划的店铺领取通过DFS中国香港或中国澳门微信小程序预订的产品时,必须出示会员卡。店内销售人员可能会要求持卡人出示附照片的有效身份证件以核实身份。  已兑换的积分不可恢复,赚取的积分不可转让,不可兑换现金。

 

只有持卡人亲自出示会员卡才能兑换积分。如果发生持卡人以外的任何人兑换积分的情况,DFS不承担责任。对于持卡人账户中的积分余额或不足,以DFS的记录为最终结果。

 

8.6–退款的积分扣除

 

如果持卡人退回已赚取积分的产品,DFS有权从持卡人的账户中扣除原始购物交易所赚取的积分数量。在发生退货的情况下,如果持卡人的积分余额不足,无法退回已赚取的积分,或者账户最近的积分余额为负,则店铺将按换货处理而不予退款。

 

全部或部分使用积分、礼品券或积分优惠券支付的交易不符合货币退款的条件。针对此类交易,只允许进行等价产品交换。

 

8.7–积分有效期和账户终止

 

T贵宾会等级如果持卡人未能在会员周期内完成合格购物,会员账户即进入不活跃状态。一旦完成合格购物,T贵宾会等级的会员账户即自动重新激活。属于其他等级的持卡人如果未能按照现有等级的续期标准完成合格购物,则会降到下一等级。

 

记入持卡人账户的积分自合格购物之日起24个月内有效。

 

持卡人可以随时终止会员资格。如果会员违反本细则或涉嫌欺诈,DFS可随时终止会员资格和相关账户。账户一旦终止,所有尚未兑换的累计积分将作废。

 

8.8–积分例外情况

 

积分赚取或兑换可能不适用于某些品牌/精品店的购物,即使在参与计划的DFS店铺和T广场店铺,购买某些品牌的产品也可能无法赚取或兑换积分。T贵宾卡积分优惠券的兑换亦是如此,积分优惠券只能用于购买特选品牌的产品。点击此处查看参与计划的店铺及品牌列表。

 

特定商品不符合赚取和/或兑换积分的条件。请向店内销售人员核实不适用的商品列表。 

 

在账户被暂停、停用和/或终止的情况下,或者在购物时DFS接受了其他促销折扣或优惠的情况下,不能赚取或兑换积分。此类其他促销包括但不限于与航空公司、酒店、信用卡发卡机构和旅行社相关或由这些单位赞助的促销。

 

积分的赚取和兑换以及T贵宾卡积分优惠券和/礼品券的兑换不适用于烟草(包括雪茄)和酒精饮料的购买(在某些司法管辖区,适用法律禁止此类赚取/兑换,或者DFS自行决定不允许此类赚取和/或兑换)。

 

如果产品的购买经确定超过了此处“合理使用指南”的限定,则不能赚取积分,DFS可随时更改该指南,恕不另行通知。根据指南,美妆类每款产品每月不能购买超过6件,或者每月总计不能超过24件;针对腕表及珠宝,任何品牌每款产品每月不能购买超过3件,或者每月不能超过4次交易;时装类每款产品不能购买超过3件,减价商品除外。任何未遵守合理使用指南的会员卡误用都可能导致持卡人的会员资格永久终止,失去所有已赚取的积分,且无任何求偿权。

 

8.9–隐私和数据保护 

 

填写顾客登记表并提交给DFS,即表示持卡人同意自愿提供个人信息,用于处理持卡人的会员计划注册事宜,并使DFS能够向持卡人提供会员计划的权益和服务。持卡人有权要求访问和更正其个人信息。有关详细信息,请参阅相关DFS平台上发布的DFS隐私政策。

 

DFS打算使用和转移持卡人的个人信息,以用于(i)直接营销和(ii)市场调查,但前提是经过持卡人同意。在顾客登记表上提供个人信息,将顾客登记表提交给DFS,并勾选顾客登记表上的“我同意将我的个人数据用于直接营销和dfs.com网站上列出的隐私政策中所述的其他目的”方框,即代表持卡人同意:

  • DFS可以使用持卡人的个人信息进行直接营销,也就是说,DFS可以联系持卡人以便推送DFS店铺的相关新闻、活动和促销,介绍顾客T贵宾会计划的相关信息以及宣传各类产品和服务,包括腕表、珠宝、香水和化妆品、时装和配饰、食品和酒精饮料;

  • DFS可以将持卡人的个人信息转移给任何DFS集团公司,供他们用于上述产品和服务的直接营销;

  • 为了消费者研究的目的,DFS可以通过传输电子数据或提交文件,将持卡人的个人信息发送给DFS合作的市场研究机构,并且市场研究机构可以联系持卡人进行此类消费者研究。

 

持卡人如果不再同意DFS使用其个人信息进行直接营销和/或不想参与消费者研究,可以随时发送电子邮件或写信告知DFS,我们的邮箱地址为dpo@dfs.com,通信地址为:香港九龙尖沙咀东么地道77号华懋广场8楼,DFS集团有限公司,收件人:数据保护专员。

 

8.10–责任  

 

如果由于持卡人的原因或者不可抗力事件造成未能执行会员计划,DFS不承担责任。如果对累积的积分数量有争议,除非另有证明,否则只有DFS数据库中包含的信息才被视为真实信息。

 

 

购买DFS旗下T广场礼品卡(“GC”)时不会累积T贵宾会等级金额和积分。T贵宾会会员在使用礼品卡付款时可以赚取T贵宾会身份积分。

 

礼品卡不能与特权折扣一起使用。除非另有说明,优惠不适用于礼品卡。

 

在任何司法管辖区内,如果适用法律禁止兑换,或者如果DFS自行决定不允许兑换,则礼品卡不得用于兑换受管制产品(如烟草和烈酒)。

 

如果任何礼品卡丢失、被盗、销毁或在未经持卡人许可的情况下使用,DFS不承担责任。如果丢失或被盗,礼品卡将不会被替换。如果读卡器仍可读取但不会被更换,则可以接受损坏或损坏的礼品卡。DFS可自行决定拒绝接受和/或取消任何有理由认为礼品卡已被盗或被欺诈篡改的礼品卡,或者如果礼品卡的所有权存在争议。取消时礼品卡上任何未使用的余额将不予退还。

 

购买和/或使用礼品卡需要完全接受本细则,顾客在购买礼品卡时我们会提供本细则,DFS和T广场店铺和/或相关DFS平台上也会提供本细则。DFS有权随时更改本细则,恕不另行通知。请参阅相关DFS平台上的更新。DFS对本条款及细则拥有最终解释权。

 

礼品卡可用于全额兑换或部分支付发卡城市的DFS旗下T广场店铺和DFS机场店销售的商品,不包括DFS不时自行决定的指定品牌和商品(如有)。

 

价值:礼品卡在购买后不能充值。

 

有效期:礼品卡的有效期通常为12个月的固定期限,但可能因国家/地区而异,并且在未来审查会员计划时可能做出更改。恕不发出礼品卡到期通知,到期后任何未使用的余额将作废。礼品卡在其到期日期后将失效,并且无法重新激活以供将来使用。

 

到期日:持卡人可以拜访发卡城市的DFS旗下T广场店铺,以核查礼品卡的到期日和余额。

 

无现金价值:礼品卡不能兑换现金或要求退款,或以其他方式转售或转让,但受适用法律限制的情况除外。

网站的内容属于DFS的财产。网站上发布的所有元素,例如声音、图像、照片、视频、文本、动画、程序、图形宪章、数据库、软件和其他基础技术均受适用的知识产权法保护,此类元素附带的所有权利,包括适用的知识产权,均属于并将继续为DFS的财产,或在适用情况下已正式授予DFS。

 

严禁对此类内容的任何部分或全部进行复制,这可能构成对版权或商标的侵权,更严重的情况下构成假冒和盗版。

 

DFS承认,顾客提供的个人数据只会在处理顾客订单以及准备发票和销售文件的必要范围内收集和使用。

 

经顾客同意,DFS还可以收集顾客的身份识别信息,以用于DFS未来的促销和营销。

 

根据适用的隐私法,顾客拥有一项永久权力,可以访问、修改、纠正、提出异议、移植和限制处理与他们有关的任何信息。

 

顾客可以按照本细则和DFS数据保护政策中规定的方法来行使这项权利。

 

如果由于第三方的原因(即使可预见)或用户或顾客的过错,或发生不可抗力(超出一方合理控制范围的任何情况,导致该方无法履行其在本细则下的义务),或发生DFS无法合理单独控制的任何其他事件,而导致无法履行本细则下的义务,则DFS不承担责任。

 

对于使用网站期间造成的直接或间接损害(无论是否可预见),DFS概不负责。也就是说,由于维护、技术问题、互联网拥塞或任何其他远程传输系统故障,而导致网站无法正常运行,DFS在任何情况下均不承担责任。

 

如果顾客遭受的损害完全由于下订单造成,而DFS需要对此承担责任,则DFS的责任仅限于赔偿顾客支付给DFS的订单金额。

 

13.1–修改

 

DFS有权更改本细则,恕不另行通知。

 

本细则的任何修改在发布后对网站用户均有效力,但不适用于之前已完成的交易。

 

顾客购物时所适用的细则版本为相关订单生效之日网站上发布的有效版本。

 

13.2–部分无效

 

如果本细则的任何条款被认定为无效、非法或不可执行,则细则的执行效力等同于不包括此类条款时的效力。 

 

13.3–证据约定

 

DFS、用户和/或顾客(“相关方”)明确同意,出于本细则的目的,各方可以通过网站的顾客服务以电子方式或电话相互交流。技术安全措施符合确保所交换数据机密性的预期用途。

 

相关方同意,各方之间交换的电子邮件可以有效证明所交换的内容及适用情况下的承诺,特别是关于传输和接受订单的内容和承诺。

 

13.4–对DFS的引用

 

本细则A部分中提及的DFS包括DFS集团有限公司(办公室位于香港九龙尖沙咀东么地道77号华懋广场8楼)及其附属公司。

此处的B部分仅适用于在澳大利亚使用服务和购买产品的用户和顾客。 

 

1- 定义

 

在本细则中,除非另有说明,否则相关词语定义如下:  

 

国家/地区特定要求:是指澳大利亚与消费者保护、海关、消费税、边境保护和税收相关的所有适用要求,特别涉及顾客签署密封声明的要求。  

 

DFS:是指DFS澳大利亚有限公司(ACN 002 625 809),位于155 George St, The Rocks, Sydney NSW 2000。 

 

价格:是指网站上显示的价格。这些价格以澳元表示,默认情况下不包括所有税费和关税。如果顾客不符合购买免税产品的条件,则顾客必须点击网站右上角的“已完税”切换按钮,查看包含所有适用税费和关税的价格。  

 

密封声明是指针对《2019年新税收制度(商品和服务税)条例》附表1第2和第3节表格中的第2项进行的申报。

 

旅客声明:是指针对《2019年新税收制度(商品和服务税)条例》附表1第2和第3节表格中的第2项进行的密封声明中包含的声明。

 

2- 免税出口流程

 

如果顾客同意执行以下操作并且自行承担相关责任,则顾客符合订购免税产品的条件: 

  • 无论是在网上还是在店内购买,在下单时告知DFS自己打算在领取产品后60天内带着产品离开澳大利亚,并提供国际航班详情。 

  • 在实际领取产品时出示国际旅行证件和护照,表明自己打算在60天内离开澳大利亚。 

  • 在实际领取购买的产品时,签署信用卡授权书、旅客声明和密封声明。  

  • 遵守密封声明中的条款。

  • 在离开澳大利亚之前,不得打开或改动装有所购商品的密封袋;以及

  • 在领取产品后60天内携带产品离开澳大利亚。 

 

如果顾客订购了免税产品,而DFS发现顾客在任何方面没有遵守第2条(本条)的规定,则将适用A部分第3.3条。 

 

3- 店内取货

 

顾客需要店内取货并支付剩余的款项,在此之后产品所有权即转移到顾客。为此,顾客可能需要提供旅行证件、护照和/或其他身份证明,签署密封声明并执行上述B部分第2条规定的步骤。  

 

如果顾客在取货日和取货日后的7天内未领取产品,则此订单将被取消,DFS将在取消后的7天内向顾客退款。 

 

4- 法定担保

  

网站上销售的产品符合澳大利亚现行的非排他性法定担保,具体包括但不限于以下担保:

 

4.1–质量合格担保

 

在遵守《澳大利亚消费者法》第54条的前提下,提供给顾客的产品质量合格,这是指产品符合同类商品通常具备的所有预期用途、外观和装饰加工合格、无缺陷、安全且耐用,包括产品性质、价格、任何包装上的说明、DFS或制造商所做的任何陈述以及其他相关情况皆无疑义。 

 

4.2–适用性担保

 

在遵守《澳大利亚消费者法》第55条的前提下,提供给顾客的产品适用于任何公开的目的以及DFS或制造商声明合理适用的任何目的。

 

4.3–凭文字说明提供产品的相关担保

 

在遵守《澳大利亚消费者法》第56条的前提下,凭文字说明提供给顾客的产品(包括在网站上展示来提供)符合相应的文字说明。 

 

4.4–退回有缺陷或不合规的产品

 

如果产品有缺陷或不合规,顾客可以联系顾客服务部。提出主张后,如果顾客要退货,应根据本细则A部分第6.2条的规定退回产品。

 

DFS将在合理时限内确认顾客所主张的退货产品缺陷或不合规是否属于上述法定担保范围或《澳大利亚消费者法》规定的其他担保范围,在适用情况下,DFS将履行相应的担保。

 

4.5–制造商明示保证

 

这些法定担保独立于制造商对特定产品做出的任何明示保证。

 

4.6–无额外担保

 

除非本细则中明确规定或提及,并且适用法律不允许排除任何担保、保证和条件,否则本条排除法律明示或默示的、与DFS履行本细则下的义务相关的、与供应或即将供应的任何产品相关的所有担保、保证、条件、条款和义务,且B部分第4条(本条)规定的权利是顾客针对缺陷产品享有的唯一排他性补救措施。 

 

5- 个人数据保护

 

关于DFS在澳大利亚收集和处理顾客个人数据的事宜,隐私政策中有详细说明,并且适用1998年隐私法(联邦)。   

  

6- 适用法律和管辖权

 

本细则受澳大利亚新南威尔士州现行法律的约束和管辖。在未友好解决任何争议的情况下,相关方同意服从新南威尔士州和澳大利亚联邦法院的专属管辖权。 

 

此处的C部分仅适用于在中国香港使用服务和购买产品的用户和顾客。 

 

1–定义

 

在本细则中,除非另有说明,否则相关词语定义如下: 

 

国家/地区特定要求:指与香港海关、消费税、边境保护和税收相关的所有适用要求。 

 

DFS:是指DFS集团有限公司,位于香港九龙尖沙咀东么地道77号华懋广场8楼。 

 

价格:是指网站上显示的价格。这些价格以港元表示,并且包括任何适用的折让金额和其他税费和关税。 

 

2–订购

 

顾客可以根据以下步骤自行选择想要在网站上订购的产品:

  • 顾客将产品添加到购物袋中;

  • 顾客输入自己的个人详细信息(例如姓名、出生日期、电子邮件地址和手机号码);

  • 如需直接从DFS旗下香港T广场店铺取货,顾客应选择“到店自提”。 

  • 送货上门只适用于中国香港的地址;

  • 顾客在检查和修改(如有需要)购物袋的内容后,通过点击“结账”让购物袋生效;

  • 顾客同意遵守所有适用的国家/地区特定要求、本细则和DFS隐私政策

  • 顾客写明信用卡类型和相应的卡号(或使用DFS接受的其他付款方式);

  • DFS会向顾客发送电子邮件或短信,确认收到订单(订单确认信);

  • 对于“到店自提”,顾客可以通过在线聊天功能联系我们的顾客服务团队,随时取消订单。取消不收取费用;

  • DFS可在顾客取货前的任何时间出于以下任何原因拒绝或取消订单:(a)根据本细则,你不符合订购相关产品的条件;(b)你订购的任何产品无法供应;(c)你提供的信息不完整或有任何不准确;(d)产品文字说明(包括价格)有任何不准确;

  • 如果DFS拒绝或不接受订单,则不会收取顾客付款。在此情况下,DFS会将购买金额按原付款方式退回;

  • 如果DFS拒绝、取消、不接受或撤销已接受的订单,DFS不承担任何责任,你无权向DFS提出任何主张。

 

3–店内取货

 

顾客需要在订单确认信中注明的日期前往相应的DFS旗下香港T广场店铺的取货柜台领取产品。 

 

顾客必须携带订单确认信才能领取产品。顾客可能需要提供ID。

 

若顾客在预定取货时间后的72小时内未领取产品,订单将被取消,DFS会将购买金额按原付款方式以港元退回给顾客。 

 

如遇到旺季及特别日子(如情人节、母亲节),DFS可能会酌情调整定价、订单截止时间及取货时间。恶劣天气情况(如8号台风)可能会导致发货至DFS中国香港店铺时产生延误。

 

4–法定担保

 

网站上销售的产品符合中国香港现行的非排他性法定担保,具体包括但不限于以下担保:

 

4.1–商销品质担保

 

在遵守《香港货品销售条例》第16条的前提下,提供给顾客的产品具有商销品质,这是指考虑到产品的任何文字说明、价格和所有其他相关情况,产品符合理性人认为满意的标准。产品的质量包括其外观和装饰加工、安全性和耐用性。产品不能有缺陷,包括不能有轻微缺陷,除非DFS已提请你注意这些缺陷。

 

4.2–适用性担保

 

在遵守《香港货品销售条例》第16条的前提下,提供给顾客的产品适用于任何公开的目的以及DFS或制造商声明合理适用的任何目的。

 

4.3–凭文字说明提供产品的相关担保

 

在遵守《香港货品销售条例》第17条的前提下,凭文字说明提供给顾客的产品(包括在网站上展示来提供)符合相应的文字说明。

 

4.4–退回有缺陷或不合规的产品

 

如果产品有缺陷或不合规,顾客可以联系顾客服务部。提出主张后,如果顾客要退货,应根据本细则A部分第6.2条的规定退回产品。

 

DFS将在合理时限内确认顾客所主张的退货产品缺陷或不合规是否属于上述法定担保范围或《香港货品销售条例》规定的其他担保范围,在适用情况下,DFS将履行相应的担保。

此处的D部分仅适用于在欧洲使用服务和购买产品的用户和顾客。 

 

1–隐私和数据保护

 

DFS作为《欧洲通用数据保护条例(EU 2016/679)》所定义的“数据控制者”,致力于保护顾客的个人数据。DFS处理顾客数据的目的是为了执行T贵宾会计划、遵守任何法律义务,或用于我们的合法利益,例如开展与我们的产品相关的研究和统计分析。 

 

在征得顾客免费自愿同意的情况下,DFS也可以将顾客的数据用于营销目的,或者向顾客发送通信。在此情况下,基于我们的合法利益,DFS将根据顾客的购物偏好和兴趣,在顾客已同意接收此类通信的前提下,对顾客的数据进行自动化处理,以用于分析和通信目的。

第1条–定义

 

在本细则中,除非另有说明,否则相关词语定义如下:

消费者保障法:即《1993年消费者保障法》(新西兰)。

国家/地区特定要求:指新西兰当地涉及消费者保护、海关、消费税、边境保护和税收方面的所有适用要求。

DFS:即DFS New Zealand Limited(327972)实体公司(地址:Cnr Customs & Albert Streets, Auckland City 1010 New Zealand)

价格:指网站上显示的每件产品的价格。这些价格以新西兰元表示,默认情况下不包括所有税费和关税。如果顾客不符合购买免税产品的条件,则顾客必须点击网站右上角的“零售”切换按钮,查看适用价格以及价格中是否包含所有适用税费和关税。通常,显示的零售价格中将包括适用关税,但不包括商品及服务税。即便如此,不符合购买免税产品资格的顾客在购买本网站所示产品时,除支付该产品显示的零售价格外,还需支付商品及服务税。在此情况下,该等产品价格将包括商品及服务税。

取货点:指在奥克兰机场国际航站楼提取DFS产品的离境取货点。

 

第2条 - 免税产品出口流程及机场提货

 

如果顾客同意执行以下操作并且自行承担相关责任,则顾客符合订购免税产品的条件:

1. 无论是在网上还是在店内购买,在下单时告知DFS自己打算在领取产品后90天内带着产品离开新西兰,并提供国际航班详情;

2. 在取货点提取产品时,出示其国际旅行证件和护照;并

3. 在离开新西兰时带走产品。

如果顾客在指定取货日或取货日后的7天内未领取产品,则此订单将被取消,DFS将在取消后的7天内向顾客退款。

 

第3条 - 订购与付款

 

就本细则A部分第1条和第5条而言,应承认,顾客在全额支付价格后即转移产品的权属和所有权,并且在顾客前往取货点提取产品前,产品风险仍由DFS承担。

就本细则A部分第3条而言,应承认:

1. A部分第3.1条第5步中提到的“店内取货”不适用,产品只能由顾客在取货点提取;并且

2. 如果已支付定金,且A部分第3.1条第11步所指的订单确认提及需要支付特定产品价格的余款,顾客须亲自到DFS店铺支付余款,而不能在取货点支付。

 

第4条–法定担保

 

DFS按照贸易过程销售和宣传其产品,因此,在网站上购买产品的顾客有权享受在新西兰生效的非排他性法定担保,包括但不限于以下担保:

 

4.1–质量合格担保

本细则受新西兰现行法律的约束和管辖。在未能友好解决任何争议的情况下,相关方同意服从新西兰法院的专属管辖权。

1.此推广活动适用于所有在以下店铺购物的现有和新加入的DFS旗下T贵宾会会员(“会员”):

• DFS旗下澳门T广场四季名店

• DFS旗下澳门T广场新濠天地店 

• DFS旗下澳门T广场美妆世界澳门银河店

 

 

2. 参与此推广活动将被视为接受所有条款及细则,所有参加者均受条款及细则约束。

 

3. DFS的董事、管理层、员工及其相关人员不得参加此促销活动。

 

4. 此推广活动有效期为2021年5月29日至30日, 时间为下午1点至5点( “推广期”)。

 

5.活动内容:

于推广期内:

a)购买美妆及香水商品满澳门币2,888元,即有机会参与幸运抽奖一次。

 

6.每位会员在每场抽奖只限中奖一次,但每名会员在推广期内(2场抽奖)可多次参与及不限中奖次数。

The Contest is organised by DFS Group Limited (CR No.: 0034425), a limited liability company incorporated in the Hong Kong SAR of the People’s Republic of China (“Hong Kong”) with its business address at 8/F, Chinachem Golden Plaza, 77 Mody Road, Tsim Sha Tsui East, Kowloon, Hong Kong (“DFS”). 1. Start / End Dates  

1.1. The Contest starts on 11 August 2021 at 12:00 A.M. Hong Kong Time (“HKT”) and ends on 28 August 2021 at 11:59 P.M. (HKT) (the “Contest Period”). Entrants may enter the Contest at any time during the Contest Period.

1.2 The sole determinant of time for the purposes of this Contest, including receipt of a valid Submission (defined below), will be the Contest computer servers (“Contest computers”). 2. Who can Enter 

2.1. To be eligible to participate, you must be an individual currently legally residing in Hong Kong or Macau SAR and at least 18 years old at the time of their entry to the Contest. Proof of eligibility may be required by DFS.

3. How to Enter
3.1 To enter the Contest: -
(a) during the Contest Period, you must have your personal Instagram account that is set to public;
(b) you must personally upload a photograph of yourself that represents one of the three themes, namely, “No Filter”, “Empowerment”, and “Diversity” (each a “Theme” and collectively the “Themes”), to your own Instagram profile (Feed, not Stories) during the Contest Period (each such photograph of yourself shall be referred to as a “Portrait”, and each uploading of a Portrait together with the caption shall be referred to as a “Submission”);
(c) the caption of the Portrait should embrace your chosen Theme and encourage others to do so as well;
(d) the caption must include the hashtag “#FirstClassBeauty2021,” and mention your chosen Theme (“No Filter”, “Empowerment”, or “Diversity”); and
(e) the caption must also mention the “@dfsofficial” Instagram page.
3.2 Using the hashtag “#DFSBestSelfForward” in your Submission is encouraged.
3.3 No purchase is necessary to enter or win. A purchase does not improve your chances of winning.
3.4 Each entrant shall only be eligible for a maximum of one (1) Submission during the Contest Period.
3.5 An entrant may only use one (1) personal Instagram account/ username to participate in the Contest.
3.6 DFS reserves the right to, in its sole and absolute discretion, exclude or disqualify any of the following entrant(s) and/or Submission(s), and forfeit the Prize(s) (as defined below) won (if applicable): -

3.7 DFS will not verify receipt of Submissions. Submissions that are late, lost, stolen, undelivered, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, generated by script, macro or other automated or mechanical means, that have been submitted through illicit means or by any means which subvert the entry process or that do not conform with or satisfy any or all of the conditions set out in these Terms and Conditions will be void. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to enter the Contest by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated program to enter will result in disqualification.

4. Content Restrictions
4.1 Each Submission shall conform to the following content restrictions, failing which shall result in immediate disqualification and removal from the Contest in DFS’ sole and absolute discretion:-
(a) Your Submission (both the Portrait and the caption) must be original and unique, and you must have all necessary rights, title, and interests in and to the Submission for the purposes of the Contest. For the avoidance of any doubt, your Portrait cannot be something that you have copied or downloaded (e.g. from the worldwide web, stock photography or otherwise), and must not be a modification, enhancement or alteration of a third party’s pre-existing work;
(b) It is your sole responsibility to make sure that the person(s) depicted in your Portrait (if any) have given his/her/their explicit consent for the photograph to be taken, submitted and uploaded for the purposes of the Contest and that no intellectual property rights of any person or entity are violated by your Submission. Company may reject or remove any Submission if it believes in its sole discretion that such required consent has not been collected and/or any third party’s intellectual property rights have been violated;
(c) The Submission must not contain any material that violates or infringes the intellectual property rights or other rights of any other person or entity;
(d) The Submission must not contain any material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous (including without limitation nudity, violence, obscenity, profanity, pornography, illegal activity or anything offensive in nature);
(e) The Submission must not contain any material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination of any kind;
(f) The Submission must not contain any material that is unlawful, in violation of or contrary to any applicable laws and regulations;
(g) The Submission must not contain any material that promotes illegal drugs or firearms (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous, or any particular political agenda or message;
(h) The Submission must not depict DFS in any way that would constitute trade disparagement or defamation, contain any defamatory or negative statements about DFS, its personnel, its products, and/or its services;
(i) The Submission must be consistent with the image and values of DFS and be consistent with and satisfy the purposes of the Contest;
(j) The Submission must not have been submitted previously in a promotion or contest of any kind or exhibited or displayed publicly through any means prior to the Contest;
(k) The Submission must not contain commercial content or promotions for any products or services other than products and services of DFS; and
(l) The Submission must not contain any identifiable third party products, trademarks, brands and/or logos, other than those of DFS (e.g. any buildings, products appearing in your Submission must not contain any visible logos, trademarks or other third party materials unless the appropriate consents have been obtained --- NOTE: all identifiable third party products, trademarks, brands and/or logos for which consent has not been obtained by the entrant must be blurred out so as to be unrecognizable).

5. Warranties and Representations
5.1 By entering the Contest, you warrant and represent the following :-
(a) the Submission is your original work;
(b) you are the sole and exclusive author and owner of the Submission;
(c) the Submission does not and will not violate or infringe any rights (including without limitation intellectual property rights) of any third parties;
(d) the third party(ies) appearing in the Submission (if any) has/have given you the appropriate explicit consent to be photographed and such photograph(s) being used in accordance with these Terms and Conditions;
(e) all information you have provided in respect of the Contest is true and accurate; and
(f) it shall be lawful for you to enter the Contest and make the Submission.

6. Determination of Winners
6.1 The following process will be used to determine the winning entry: -
(a) After the Contest Period, Submissions will be judged by a panel of judges selected by DFS, which may include members of DFS’ marketing team and DFS’ advertising and promotional agencies (the “Judging Panel”); and
(b) All Submissions (both the Portrait and the caption) will be judged at the sole and absolute discretion of the Judging Panel according to the following criteria in equal measure: (i) quality, meaning the brightness and evenness of illumination, contrast, resolution, geometry and colour; (ii) creativity, meaning the artistic interpretation of one of the Themes; and (iii) uniqueness, meaning unlike anything else and originality.
6.2 By submitting a Submission, entrants agree to abide by the aforesaid process of winner selection and the Judging Panel’s decision, which shall be final and binding in all matters related to the Contest.

7. Prizes
7.1 There are a total of three (3) bundles of prizes (each bundle a “Prize” and collectively the “Prizes”), each of which includes one (1) Guerlain – Limited Edition KISSKISS Creamy Shaping Lip Color, one (1) Shu Uemura – Cleansing Oil (mini size), one (1) Shiseido – ULTIMUNE Power Infusing Concentrate (full size), and one (1) Clé de Peau Beauté – Cleansing Cream Oil (full size), at a total cost of around HK$2,195.00.
7.2 One (1) winner will be selected per Theme. The odds of winning a Prize depend on the number, quality, creativity and uniqueness of eligible Submissions received.
7.3 If a Prize (or part of the Prize) becomes unavailable for reasons beyond DFS’ control, DFS, to the extent permitted by law, reserves the right to substitute the Prize (or that part of a Prize) with a prize that in DFS’ discretion is determined to be of equal or similar value and that is reasonably similar to the original Prize.
7.4 The Prizes will be addressed and mailed to the winners according to their contact details shared with DFS after the winners have been announced.
7.5 All Prizes are non-negotiable, non-transferrable and not redeemable for cash, coupons, DFS Gift Cards, DFS vouchers, store credits, any other forms of credit, and/or any other membership points or services. Prizes are provided "as is" without further representation, warranty or guarantee of any kind, express or implied. In no event shall DFS be obligated to award any of the Prizes should it determine, in its sole and absolute discretion, that the Submissions are unsatisfactory. Winners are solely responsible for all federal, state, and local taxes and other fees associated with the receipt and/or use of the Prizes.

8. Notification of Winners and Prize Collection
8.1 Winners will be announced on DFS’ official Instagram Page (i.e. “dfsofficial” Instagram page) on 1 September 2021 (HKT).
8.2 Winners will also be contacted by DFS via Instagram’s Direct Message feature with the Instagram usernames used by the winners to enter the Contest (each a “Registered Instagram Username”) on 1 September 2021 (HKT).
8.3 If requested by DFS, a winner shall within three (3) days of Prizes notification: -
(a) sign and return a liability / publicity release and/or license agreement (in DFS’ standard form without amendment); and/or
(b) submit release(s) and/or authorization(s) (in DFS’ standard form without amendment) from any and all third party(ies) appearing in his/her Submission (if applicable), without any payment or consideration to be paid by DFS,failing which may result in disqualification of the Submission and the winner, as well as the forfeiture of the Prize, in DFS’ sole and absolute iscretion.
8.4 If one of the following events occurs, the Prize(s) shall be forfeited and DFS reserves the right to award such Prize(s) or any part thereof to other winner(s) or reserve entries, if applicable, in its sole and absolute discretion: -
(a) a winner cannot be contacted with the Registered Instagram Username within three (3) days of the Prize notification;
(b) a winner rejects his/her Prize; and
(c) a winner fails to comply with these Terms and Conditions.
8.5 Winners’ names and/or usernames and Submissions may be published on DFS’ website and/or social media channel(s) (including, but not limited to, DFS’ official Instagram page).
8.6 An entrant is not deemed a winner of any Prize, even if the winning notification should so indicate, unless and until the entrant's eligibility has been verified, all required documents returned and executed, and the entrant has been notified that the acceptance and verification process is complete.

9. Intellectual Properties
9.1 By entering the Contest, you agree for DFS to feature your Submission on DFS’ website and/or social media channel(s) (including, but not limited to, DFS’ official Instagram page) and you agree:-
(a) to give DFS a royalty-free, irrevocable, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, on a worldwide basis and in perpetuity, and to incorporate it into other works, in any form, media or technology now known or later developed (and the right to sub-license and assign) for the purposes of implementing the Contest, product and brand marketing and promotions by DFS and/or all commercial purposes;
(b) that DFS dealing with your Submissions in any way that may otherwise violate or infringe your moral rights, and you agree not to assert your moral rights (if any) in respect of your Submissions against DFS or its assigns, licensees or successors; and
(c) that you shall execute all such documents and take such other steps as may from time to time be necessary for the purposes above.

10. Conditions, Limitations and Liabilities
10.1 By entering the Contest, you agree to release, hold harmless and indemnify DFS, its advertising and promotional agencies, the Judging Panel and any member of DFS, or other party in any way involved in the development or administration of this Contest, including suppliers of materials or services related to the Contest and all of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (the “Releasees”) for all losses, costs, damages or claims arising as a result of or in connection with your Submissions, participation in the Contest, judging of Submissions, the awarding, accepting, arranging or use of the Prizes, non-compliance with these Terms and Conditions or any applicable laws and regulations and/or violation or infringement of any third party rights.
10.2 Without limiting the generality of the foregoing, the Releasees are not responsible for and expressly disclaim any and all liabilities associated with: -
(i) incorrect or inaccurate Submission information, including communication failures or human error that may occur in the receipt or processing of Submissions, or for destruction of or unauthorized access to, or alteration of, Submissions in a manner that is not expressly allowed under these Terms and Conditions;
(ii) late, lost, stolen, misleading, damaged, misdirected, garbled, incomplete, altered or otherwise irregular Submissions or transmissions, those that have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Terms and Conditions;
(iii) any loss, damage, or claims caused by, or in any way related to an awarded Prize or the Contest itself;
(iv) any problems or technical malfunctions;
(v) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused;
(vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise;
(vii) any claims regarding the judging of Submissions, or the awarding, accepting, arranging or use of the Prizes; or
(viii) electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind.
Submission material/data that has been tampered with or altered is void.
10.3 Releasees shall not be liable: -
(a) for exercising DFS’ rights under these Terms and Conditions or as otherwise permitted by law, if the Contest cannot take place or if any Prize cannot be awarded or redeemed due to causes beyond its control or otherwise not allowed under the applicable laws and regulations;
(b) for technical malfunctions, errors or failure of any kind, lost Submissions, lost or unavailable network connections, Instagram, Internet or ISP availability, or failed, incomplete or delayed computer or mobile device transmissions which may limit one’s ability to enter the Contest, including any damage to any computer or mobile device relating to or resulting from participating in the Contest; and
(c) for damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages.

11. Reservation of Rights
11.1 DFS reserves the right to, at its sole and absolute discretion and without any prior notice whatsoever:-
(a) cancel, terminate, modify, extend or suspend the Contest or amend or substitute any of these Terms and Conditions at any time and for any reason, including without limitation where the administration, security, fairness or proper conduct of the Contest shall be corrupted or affected by virus, bugs, fraud or other causes beyond its control, or the receipt of an insufficient number of Submissions; and/or
(b) disqualify any entrant or Submission for any reason, including without limitation for non-compliance with these Terms and Conditions, tampering with the entry process or the operation of the Contest, attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception or other unfair playing practices, acting in an unsportsmanlike manner or intending to annoy, abuse, threaten or harass any other entrants or DFS representatives. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE CONTEST INSTAGRAM PAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, DFS WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTEST(S).
11.2 In the event that the operation of the Contest or any part thereof (a) shall require any prior approval, consent and/or permit from any competent authorities of any jurisdictions; and/or (b) under these Terms and Conditions (as may be amended or substituted from time to time) shall be contrary to any applicable laws and regulations of any jurisdictions, the relevant jurisdictions shall automatically be excluded from the Contest and no entrants of such jurisdictions shall be eligible to enter into the Contest.
11.3 DFS reserves the rights to conduct verification of the Submission(s) by contacting the entrant(s) and to request additional information relevant to the participation in the Contest.
11.4 DFS’ decisions are final and binding in all matters relating to the Contest.

12. Disputes and Governing Law
12.1 If a dispute arises between the entrant and DFS, DFS encourages entrants to try and resolve the dispute by first contacting DFS to seek a resolution. If a dispute cannot be resolved, then the entrant and DFS irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong.
12.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute, controversy or claim arising out of or relating to these Terms and Conditions, or the breach, termination or invalidity of these Terms and Conditions, shall be submitted exclusively to the competent Courts in Hong Kong.

13. General
13.1 Each of the provisions in these Terms and Conditions shall be construed independently of every other such provision. In the event that any one or more of the provisions of these Terms and Conditions shall be determined by any court or competent authority to be illegal, invalid and/or unenforceable in any respect, then such determination shall not affect any other provision of these Terms and Conditions, all of which shall remain in full force and effect. You agree that in place of the unenforceable provision or provisions shall be substituted a new provision or provisions as like in force and effect as may be permitted by law.
13.2 Any person other than an entrant to the Contest or DFS shall not benefit from or be entitled to enforce any provision of these Terms and Conditions. Any person other than an entrant to the Contest or DFS shall not benefit from or be entitled to enforce any provision of these Terms and Conditions. DFS shall not be required to notify or obtain the consent of any party in order to rescind or vary these Terms and Conditions.
13.3 Intellectual Property: All intellectual property, including but not limited to trademarks, trade names, designs, Contest materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by either DFS and/or their respective affiliates or authorized licensors. All rights are reserved. Unauthorized copying or use of any copyrighted materials or intellectual property without the express written consent of its owner is strictly prohibited.

14. Use of Data
14.1 DFS will be collecting personal data of entrants for the purposes of conducting this Contest, which may include disclosure to third parties for the purpose of processing and conducting the Contest, and for promotional purposes surrounding this Contest, in accordance with its Privacy Policy available at https://www.dfs.com/en/privacy-policy. By entering the Contest, entrants agree to DFS’ collection and usage of personal data and acknowledge that they have read and accepted DFS’ Privacy Policy. The personal data collected will be retained for as long as required to fulfil the aforesaid purposes.
14.2 The personal data provided by entrants to the Contest will be used to send them promotional, marketing or publicity communications only if they consent to such use.
14.3 DFS will also ask entrants to allow DFS to use their name, entry, image and/or voice in the event that they are a winner in any media for a one (1) year period of time without remuneration for the purpose of promoting this Contest (including any outcome) and/or promoting products manufactured, distributed and/or supplied by DFS.
14.4 Entrants have the right to withdraw their consent and to access, change and/or update and/or delete their personal data.

15. Translations; Terms and Conditions Govern
15.1 These Terms and Conditions shall be in English only, which language shall prevail, govern and control in all aspects, and all translated versions of these Terms and Conditions in any other language shall be for reference only and shall not be binding. In the event of any discrepancy or inconsistency between the English version and any translated version, the English version shall prevail.
15.2 In the event of any discrepancy or inconsistency between the Terms and Conditions and disclosures or other statements contained in any Contest related materials, the Terms and Conditions shall prevail, govern and control.

7. Prizes

8.1 Winners (i.e. the Facebook usernames used by the winners to enter the Giveaway (each a “Registered Facebook Username”)) will be announced on DFS’ Facebook page and via Facebook comment under the Giveaway post on 27 August 2021 (HKT).
8.2 Winners will also be contacted by DFS via Facebook’s private message feature with the Registered Facebook Usernames on 27 August 2021 (HKT).
8.3 If requested by DFS, winners shall within three (3) days of Prizes notification, sign and return a liability / publicity release and/or license agreement (in DFS’ standard form without amendment), failure of which may result in disqualification of the Submission and the winner, as well as the forfeiture of the Prize, in DFS’ sole and absolute discretion.
8.4 If one of the following events occurs, the Prize(s) shall be forfeited and DFS reserves the right to award such Prize(s) or any part thereof to other winner(s) or reserve entries, if applicable, in its sole and absolute discretion: -
(a) a winner cannot be contacted with the Registered Facebook Username within three (3) days of the Prize notification;
(b) a winner rejects his/her Prize; and
(c) a winner fails to comply with these Terms and Conditions.
8.5 An entrant is not deemed a winner of any Prize, even if the winning notification should so indicate, unless and until the entrant's eligibility has been verified, all required documents returned and executed, and the entrant has been notified that the acceptance and verification process is complete.

9. Conditions, Limitations and Liabilities
9.1 By entering the Giveaway, you agree to release, hold harmless and indemnify DFS, its advertising and promotional agencies, the Judging Panel and any member of DFS, or other party in any way involved in the development or administration of this Giveaway, including suppliers of materials or services related to the Giveaway and all of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (the “Releasees”) for all losses, costs, damages or claims arising as a result of or in connection with your Submissions, participation in the Giveaway, judging of Submissions, the awarding, accepting, arranging or use of the Prizes, non-compliance with these Terms and Conditions or any applicable laws and regulations and/or violation or infringement of any third party rights.
9.2 Without limiting the generality of the foregoing, the Releasees are not responsible for and expressly disclaim any and all liabilities associated with: -
(i) incorrect or inaccurate Submission information, including communication failures or human error that may occur in the receipt or processing of Submissions, or for destruction of or unauthorized access to, or alteration of, Submissions in a manner that is not expressly allowed under these Terms and Conditions;
(ii) late, lost, stolen, misleading, damaged, misdirected, garbled, incomplete, altered or otherwise irregular Submissions or transmissions, those that have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Terms and Conditions;
(iii) any loss, damage, or claims caused by, or in any way related to an awarded Prize or the Giveaway itself;
(iv) any problems or technical malfunctions;
(v) any errors, omissions, incorrect or inaccurate information in any Giveaway-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Giveaway howsoever caused;
(vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise;
(vii) any claims regarding the judging of Submissions, or the awarding, accepting, arranging or use of the Prizes; or
(viii) electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind.
Submission material/data that has been tampered with or altered is void.
9.3 Releasees shall not be liable: -
(a) for exercising DFS’ rights under these Terms and Conditions or as otherwise permitted by law, if the Giveaway cannot take place or if any Prize cannot be awarded or redeemed due to causes beyond its control or otherwise not allowed under the applicable laws and regulations;
(b) for technical malfunctions, errors or failure of any kind, lost Submissions, lost or unavailable network connections, Facebook, Internet or ISP availability, or failed, incomplete or delayed computer or mobile device transmissions which may limit one’s ability to enter the Giveaway, including any damage to any computer or mobile device relating to or resulting from participating in the Giveaway; and
(c) for damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages.

10. Reservation of Rights
10.1 DFS reserves the right to, at its sole and absolute discretion and without any prior notice whatsoever:-
(a) cancel, terminate, modify, extend or suspend the Giveaway or amend or substitute any of these Terms and Conditions at any time and for any reason, including without limitation where the administration, security, fairness or proper conduct of the Giveaway shall be corrupted or affected by virus, bugs, fraud or other causes beyond its control, or the receipt of an insufficient number of Submissions; and/or
(b) disqualify any entrant or Submission for any reason, including without limitation for non-compliance with these Terms and Conditions, tampering with the entry process or the operation of the Giveaway, attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception or other unfair playing practices, acting in an unsportsmanlike manner or intending to annoy, abuse, threaten or harass any other entrants or DFS representatives. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE GIVEAWAY FACEBOOK PAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, DFS WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE GIVEAWAY.
10.2 In the event that the operation of the Giveaway or any part thereof (a) shall require any prior approval, consent and/or permit from any competent authorities of any jurisdictions; and/or (b) under these Terms and Conditions (as may be amended or substituted from time to time) shall be contrary to any applicable laws and regulations of any jurisdictions, the relevant jurisdictions shall automatically be excluded from the Giveaway and no entrants of such jurisdictions shall be eligible to enter into the Giveaway.
10.3 DFS reserves the rights to conduct verification of the Submission(s) by contacting the entrant(s) and to request additional information relevant to the participation in the Giveaway.
10.4 DFS’ decisions are final and binding in all matters relating to the Giveaway.

11. Disputes and Governing Law
11.1 If a dispute arises between the entrant and DFS, DFS encourages entrants to try and resolve the dispute by first contacting DFS to seek a resolution. If a dispute cannot be resolved, then the entrant and DFS irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong.
11.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute, controversy or claim arising out of or relating to these Terms and Conditions, or the breach, termination or invalidity of these Terms and Conditions, shall be submitted exclusively to the competent Courts in Hong Kong.

12. General
12.1 Each of the provisions in these Terms and Conditions shall be construed independently of every other such provision. In the event that any one or more of the provisions of these Terms and Conditions shall be determined by any court or competent authority to be illegal, invalid and/or unenforceable in any respect, then such determination shall not affect any other provision of these Terms and Conditions, all of which shall remain in full force and effect. You agree that in place of the unenforceable provision or provisions shall be substituted a new provision or provisions as like in force and effect as may be permitted by law.
12.2 Any person other than an entrant to the Giveaway or DFS shall not benefit from or be entitled to enforce any provision of these Terms and Conditions. Any person other than an entrant to
the Giveaway or DFS shall not benefit from or be entitled to enforce any provision of these Terms and Conditions. DFS shall not be required to notify or obtain the consent of any party in order to rescind or vary these Terms and Conditions.
12.3 Intellectual Property: All intellectual property, including but not limited to trademarks, trade names, designs, Giveaway materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by either DFS and/or their respective affiliates or authorized licensors. All rights are reserved. Unauthorized copying or use of any copyrighted materials or intellectual property without the express written consent of its owner is strictly prohibited.

13. Use of Data
13.1 DFS will be collecting personal data of entrants for the purposes of conducting this Giveaway, which may include disclosure to third parties for the purpose of processing and conducting the Giveaway, and for promotional purposes surrounding this Giveaway, in accordance with its Privacy Policy available at ttps://www.dfs.com/en/privacy-policy. By entering the Giveaway, entrants agree to DFS’ collection and usage of personal data and acknowledge that they have read and accepted DFS’ Privacy Policy. The personal data collected will be retained for as long as required to fulfil the aforesaid purposes.
13.2 The personal data provided by entrants to the Giveaway will be used to send them promotional, marketing or publicity communications only if they consent to such use.
13.3 DFS will also ask entrants to allow DFS to use their name, entry, image and/or voice in the event that they are a winner in any media for a one (1) year period of time without remuneration for the purpose of promoting this Giveaway (including any outcome) and/or promoting products manufactured, distributed and/or supplied by DFS.
13.4 Entrants have the right to withdraw their consent and to access, change and/or update and/or delete their personal data.

14. Translations; Terms and Conditions Govern
14.1 These Terms and Conditions shall be in English only, which language shall prevail, govern and control in all aspects, and all translated versions of these Terms and Conditions in any other language shall be for reference only and shall not be binding. In the event of any discrepancy or inconsistency between the English version and any translated version, the English version shall prevail.
14.2 In the event of any discrepancy or inconsistency between the Terms and Conditions and disclosures or other statements contained in any Giveaway related materials, the Terms and Conditions shall prevail, govern and control.
