DFS CIRCLE Promotion Terms and Conditions
The DFS CIRCLE Claw Machine Game Promotion (“Promotion”) is organized by DFS Group Limited, a company registered under the laws of Hong Kong SAR with its office address at 15/F One Taikoo Place, 979 King's Road, Quarry Bay, Hong Kong (“DFS”).
Participation in this Promotion is deemed acceptance of these Terms and Conditions (“Terms”) and all participants agree to be bound by them.
Eligibility
To be eligible for participating in the Promotion, the participant must be an individual who has signed up as a member of the DFS CIRCLE Membership Program via the DFS CIRCLE Mobile App or via DFS Official WeChat Mini Program.
Employees of DFS and their immediate families are ineligible to enter the Promotion.
Promotion and How to Participate
The Promotion commences on April 27, 2023 and ends on May 31, 2023 (both days inclusive), until stock of Prizes (as defined below) lasts (“Promotional Period”).
To be eligible for the Promotion, participants must complete the following steps on the same day, during the Promotional Period:
Present their DFS CIRCLE Membership Card and make a single net purchase of HK$2,500 or more (“Qualifying Purchase”), at T Galleria by DFS, Hong Kong, Canton Road (“Participating Store”);
Present the original valid receipt of the Qualifying Purchase at a designated promotion counter in the Participating Store; and
Participate in the Claw Machine Game at the Participating Store to grab a prize token (“Prize Token”) to redeem a Prize (as defined below).
A valid receipt of a Qualifying Purchase must be machine-printed and issued by DFS at the Participating Store with receipt number, transaction number, transaction date and amount of transaction. Revised, re-printed, copied, photocopied, handwritten, damaged, altered, or fraudulently obtained (at DFS’ sole discretion) receipt is not accepted.
Participant is entitled to one (1) Prize for his/her participation in the Promotion per every one (1) Qualifying Purchase, and may earn more than one (1) Prize by making more than one (1) Qualifying Purchase.
Each Prize Token is visibly marked with and is redeemable for one (1) specific Prize. The prizes (“Prize(s)”) available in this Promotion consist of:

The Prize or entitlement for collection of the Prize (as the case may be) will be distributed to the winner of the Prize immediately (“Winner”). If a Prize (or part of the Prize) becomes unavailable for reasons beyond DFS’ control, DFS, to the extent permitted by law, reserves the right to substitute the Prize (or that part of a Prize) with a prize that in DFS’ discretion is determined to be of equal or similar value and that is reasonably similar to the original Prize.
DFS is not the supplier or manufacturer of the Prizes. Prizes are provided AS-IS and subject to their own applicable terms and conditions. DFS makes no warranties, representations or guarantees, whether expressed or implied, including, but not limited to, any merchantability of a relevant Prize or its fitness for a particular purpose. Any complaints about a Prize should be directed to the supplier or manufacturer of the relevant Prize. DFS will not be liable for any direct or indirect injury, loss and/or consequences that may arise from the use of the Prize or its related services by the Winner.
All Prizes are for personal use only, and may not be resold or offered for resale or used for any commercial purposes whatsoever. Any such resale or commercial use may result in Prize forfeiture.
A Prize Token, a Prize, or any part of the Prize, is not exchangeable for any other benefits, including, without limitation, DFS gift cards, cash or other monetary value, store credits, membership points, any complimentary services or other promotions in any kind, unless otherwise expressly specified.
If the Winner fails to redeem the Prize with the Prize Token on the same day he/ she participated in the Promotion, the Winner will be deemed to have waived the right to redeem the Prize and DFS reserves the right to the Prize. Winners may not transfer their Prize eligibilities to others.
If a Winner seeks refund for item(s) they purchased in the Qualifying Purchase to which resulted in them winning the Prize, such refunds shall only be processed on the basis that the Winner also returns the Prize in its original, unused, unopened, and undamaged state.
Changes to the Promotion and other DFS’ rights
DFS reserves the right to, at its sole and absolute discretion, to suspend, revise or terminate the Promotion and to amend these Terms at any time without prior notice.
DFS may exercise such right in circumstances, such as but not limited to, circumstances where the Promotion is interfered with or not capable of being conducted as anticipated due to any unforeseeable circumstances beyond DFS’ reasonable control, including but not limited to, technical errors, unauthorized intervention or fraud.
DFS will provide reasonable notice of any material changes to these Terms or the Promotion by publishing the amended Terms or updated Promotion information, as applicable, on DFS.com.
DFS reserves the right, at any time, to verify the validity of entries and to conduct verifications about the participants (including a participant’s identity).
DFS reserves the right to, at its discretion, exclude or disqualify, without prior notice, any participant or entry, including but not limited to, in circumstances where DFS has reason to believe that the participant is ineligible, has breached a provision of these Terms, tampered with the entry process or engaged in any unlawful or other serious misconduct that has jeopardised the fairness, integrity or proper conduct of the Promotion.

Participants acknowledge that all personal data provided by them (if any) are collected, processed, stored and/or used in accordance with DFS’ Privacy Policy accessible at https://www.dfs.com/en/privacy-policy.

Participants’ acknowledgements and obligations, limitation of liabilities
Each participant acknowledges that:
DFS is not responsible for any incorrect or in any incorrect or inaccurate information or other errors that may occur in the course of conducting the Promotion;
Any representation, warranty, condition or undertaking that would be implied in these Terms by legislation, common law, equity, trade, custom or usage is excluded to the maximum extent permitted by law; and
Except for any liability that cannot by law be excluded, DFS (including its officers, employees and agents) will not be liable for any damage, expenses, costs, liability, injury, claims, or loss whatsoever, whether direct, indirect or consequential, in contract, tort (including negligence), under statute or otherwise, arising out of or in connection with the Promotion.
General
Failure by DFS to enforce any of its rights at any stage does not constitute a waiver of those rights. DFS’ legal rights to recover damages or other compensation are reserved.
The English version of these Terms shall prevail if there are discrepancies or ambiguities among the different language versions of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR.
If a dispute arises between the participant and DFS, DFS encourages participants to try and resolve the dispute by first contacting DFS to seek a resolution. If a dispute cannot be resolved, then the participant and DFS irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong SAR.
